The Innovative Design Protection and Piracy Prevent Act was introduced in the Senate on August 5, 2010
As reported in the article, “Design Piracy Bill Faces Legal Hurdles,” in today’s Women’s Wear Daily, the legislation, if it passes, would create three new legal standards — an originality standard, an infringement standard and a heightened pleading standard. The bill, if passed, leaves much in question about phrases it includes such as, ‘substantially identical’ and might warrant interpretation by the courts.
